Freedom Of Information Act: The Freedom of Information Act. 5 U.S.C. § 552, As Amended By Public Law No. 104-231, 110 Stat. 3048. Below is the partial text of the Freedom of Information Act. There were many amendments to the statute made by the “Electronic Freedom of Information Act Amendments of 1996.”
The Freedom of Information Act (FOIA) is a federal law that allows for the full or partial disclosure of previously unreleased information and documents controlled by the United States Government. The Act defines agency records subject to disclosure, outlines mandatory disclosure procedures and grants nine exemptions to the statute. It was signed into law by President Lyndon B. Johnson on July 4, 1966 (Public Law 89-554, 80 Stat. 383; Amended 1996, 2002, 2007), and went into effect the following year.
With the passage of the FOIA, the burden of proof shifted from the individual to the government. Those seeking information are no longer required to show a need for information. Instead, the “need to know” standard has been replaced by a “right to know” doctrine. The government now has to justify the need for secrecy. Cyber-Bullying/Cyber-Stalking: Cyber-bullying is “the use of information and communication technologies to support deliberate, repeated, and hostile behavior by an individual or group, that is intended to harm others”. As it has become more common in society, particularly among young people, legislation and awareness campaigns have arisen to combat it. Cyber-bullying has been defined as “when the Internet, cell phones or other devices are used to send or post text or images intended to hurt or embarrass another person”, or as “when an electronic device is used to attack or defame the character of a real person. Often embarrassing or false information about the victim is posted in an online forum where the victim and those who know the victim can see it publicly.” Other researchers use similar language to describe the phenomenon.
Cyber-bullying can be as simple as continuing to send e-mail to someone who has said they want no further contact with the sender, but it may also include threats, sexual remarks, pejorative labels (i.e., hate speech), ganging up on victims by making them the subject of ridicule in forums, and posting false statements as fact aimed at humiliation. Cyber-bullies may disclose victims’ personal data (e.g. real name, address, or workplace/schools) at websites or forums or may pose as the identity of a victim for the purpose of publishing material in their name that defames or ridicules them. Some cyber-bullies may also send threatening and harassing emails and instant messages to the victims, while other post rumors or gossip and instigate others to dislike and gang up on the target. Whether the bully is male or female, their purpose is to intentionally embarrass others, harass, intimidate, or make threats online to one another. This bullying occurs via email, text messaging, posts to blogs, and Web sites.
The practice of cyber-bullying is not limited to children and, while the behavior is identified by the same definition in adults, the distinction in age groups is sometimes referred to as cyber-stalking or cyber-harassment when perpetrated by adults toward adults, sometimes directed on the basis of sex. Common tactics used by cyber-stalkers are to vandalize a search engine or encyclopedia, to threaten a victim’s earnings, employment, reputation, or safety. A repeated pattern of such actions against a target by an adult constitutes cyber-stalking.
Research has demonstrated a number of serious consequences of cyber-bullying victimization. For example, victims have lower self-esteem, increased suicidal ideation, and a variety of emotional responses, retaliating, being scared, frustrated, angry, and depressed. One of the most damaging effects is that a victim begins to avoid friends and activities, often the very intention of the cyber-bully. Cyber-bullying campaigns are sometimes so damaging that victims have committed suicide. Studies are being conducted by large companies to gauge loss of revenue through malicious false postings. Cyber-stalkers seek to damage their victim’s earnings, employment, reputation, or safety. A 2008 High Court ruling determined that, generally speaking, slander is when a defamatory statement has been made orally without justification. Libelous statements are those that are recorded with some degree of permanence. This would include statements made by email or on online bulletin boards.
In Conclusion: Cyber-Bullying and/or Cyber-Stalking or harassment will NOT ever be tolerated on GIWAYNE.COM or any platform that verifiable by the host (ie. Twitter, Facebook, Blog Talk Radio, etc). All forms of harassment that I receive, will be reported to the proper authorities and all of your words will be screen capped for proof.
